USCIS Halts the Keeping Families Together (KFT) Parole Process Following Court Ruling

On November 7, 2024, the United States District Court for the Eastern District of Texas issued a judgment in the case of State of Texas v. Department of Homeland Security, vacating the Keeping Families Together (KFT) parole process.

The Keeping Families Together program was designed to create a pathway for noncitizen spouses and stepchildren of U.S. citizens to correct their status in the United States. The Court ruled that the Biden administration did not have the power to issue this type of parole in place and declared the KFT parole process invalid. This means that the U.S. Citizenship & Immigration Services (USCIS) cannot accept, process, or issue a decision on any pending applications at this time.

Immediate USCIS Actions

To comply with the court’s order, USCIS has announced several critical steps:

  1. Suspension of Form I-131F Applications: USCIS will not adjudicate any pending Form I-131F applications related to the KFT parole process. Furthermore, new applications for Form I-131F will no longer be accepted.
  2. Cancelled Appointments: If you have an upcoming Application Support Center (ASC) appointment for a previously filed Form I-131F, consider it immediately canceled. USCIS has made it clear that anyone who appears for these appointments will be turned away.
  3. Cancellation of External Engagements: USCIS has also canceled any scheduled external engagements related to the KFT parole process, further indicating the suspension of this program.

What Happens Next?

USCIS has stated that more guidance will be issued soon regarding how it will process the cases that are already in the system and how it will handle application fees already paid. Applicants are advised to regularly check the USCIS website for the latest updates.

With the sudden halt to the KFT parole process, the uncertainty surrounding future immigration relief programs is heightened. Affected individuals and families should stay informed about upcoming developments and consult legal experts for guidance on their specific cases.

USCIS Suspende el Proceso de Permiso Humanitario “Keeping Families Together” (KFT) Tras Fallo Judicial

El 7 de noviembre de 2024, el Tribunal de Distrito de los Estados Unidos para el Distrito Este de Texas emitió un fallo en el caso State of Texas v. Department of Homeland Security, anulando el proceso de permiso humanitario “Keeping Families Together” (KFT).

El programa Keeping Families Together fue diseñado para crear un camino que permitiera a los cónyuges e hijastros no ciudadanos de ciudadanos estadounidenses regularizar su estatus migratorio en los Estados Unidos. Sin embargo, el tribunal dictaminó que la administración Biden no tenía la autoridad para implementar este tipo de permisos y declaró inválido el proceso KFT.
