On January 29, 2025, President Trump signed the Laken Riley Act. This law will require the Department of Homeland Security (DHS) to mandatorily detain anyone who entered the United States unlawfully and is then charged with, arrested for, convicted of, or admitted to committing:

• Burglary;
• Theft;
• Larceny;
• Shoplifting;
• Assault on a law enforcement officer; or
• Any crime that results in death or serious bodily injury to another person.

Mandatory detention means that an individual will be detained at an immigration detention facility without the ability to request a bond. Instead, they will remain detained while they fight their case against deportation before an Immigration Judge.

We do not yet know whether this law will be applied retroactively and affect people with a prior criminal history.

What does this mean?

• If you entered the United States lawfully, then this law does not apply to you.
• If you entered the United States unlawfully and you have future criminal legal contact related to the crimes listed above, then this law does apply to you.
• If you entered the United States unlawfully and you had prior criminal legal contact related to the crimes listed above, then this law may apply to you.
• This law does not affect your ability to defend yourself against deportation, if you are eligible. It only affects your ability to be released from immigration custody while your case before the Immigration Court is pending.

• Si ingresó a los Estados Unidos de manera legal, esta ley no se aplica a su caso.
• Si ingresó a los Estados Unidos de manera ilegal y tiene futuro contacto legal penal relacionado con los delitos enumerados anteriormente, esta ley se aplica a su caso.
• Si ingresó a los Estados Unidos de manera ilegal y tuvo contacto legal penal previo relacionado con los delitos enumerados anteriormente, esta ley se puede aplicar a su caso.
• Esta ley no afecta su capacidad de defenderse contra la deportación, si es elegible. Solo afecta su capacidad de ser liberado de la custodia de inmigración mientras su caso ante la Corte de Inmigración está pendiente.
