On January 29, 2025, President Trump signed the Laken Riley Act. This law will require the Department of Homeland Security (DHS) to mandatorily detain anyone who entered the United States unlawfully and is then charged with, arrested for, convicted of, or admitted to committing:
Mandatory detention means that an individual will be detained at an immigration detention facility without the ability to request a bond. Instead, they will remain detained while they fight their case against deportation before an Immigration Judge.
We do not yet know whether this law will be applied retroactively and affect people with a prior criminal history.
