Texas Court Issues Administrative Stay – pausing Biden’s Keeping Families Together program

On Monday, August 19, 2024, the Department of Homeland Security (DHS) U.S. Citizenship & Immigration Services (USCIS) began accepting applications (Form I-131F) for Parole-in-Place (PIP) under President Biden’s Keeping Families Together (KFT) program.

On Friday, August 23, 2024, thirteen (13) states filed a lawsuit, State of Texas v. Department of Homeland Security, in the Eastern District of Texas challenging the Biden Administration’s Keeping Families Together program.

On Monday, August 26, 2024, the Judge issued an order temporarily pausing USCIS’s ability to adjudicate and approve PIP applications while the Court completes a review of the record. This administrative stay will stay in effect for 14 days and may be extended after the 14-day period.

During this temporary pause, USCIS announced that it will continue to accept I-131F applications for PIP under the Keeping Families Together program, but it will not issue any final decisions on pending I-131F applications while the Judge’s Order remains in place.

It is possible that the temporary pause will be lifted and USCIS will resume adjudicating I-131F applications for Keeping Families Together. It is also possible that the Texas Court will order the Keeping Families Together program to stop permanently. At this time, we simply do not know when or whether Keeping Families Together applications will be approved in the future.

El lunes 19 de agosto de 2024, el Departamento de Seguridad Nacional (DHS), a través de los Servicios de Ciudadanía e Inmigración de EEUU (USCIS), comenzó a aceptar solicitudes (Formulario I-131F) para el programa de Parole-in-Place (PIP) bajo el programa “Manteniendo a las Familias Unidas” (Keeping Families Together, KFT) del presidente Biden.

El viernes 23 de agosto de 2024, trece (13) estados presentaron una demanda, Estado de Texas contra el Departamento de Seguridad Nacional, en el Distrito Este de Texas, impugnando el programa “Manteniendo a las Familias Unidas” de la Administración Biden.

El lunes 26 de agosto de 2024, el juez emitió una orden que suspende temporalmente la capacidad de USCIS para adjudicar y aprobar solicitudes de PIP mientras el Tribunal completa una revisión del expediente. Esta pausa administrativa permanecerá en efecto durante 14 días y podría extenderse después de este período.

Durante esta pausa temporal, USCIS anunció que continuará aceptando solicitudes I-131F para PIP bajo el programa “Manteniendo a las Familias Unidas”, pero no emitirá decisiones finales sobre las solicitudes I-131F pendientes mientras la Orden del Juez siga vigente.

Es posible que la pausa temporal se levante y USCIS reanude la adjudicación de solicitudes I-131F para el programa “Manteniendo a las Familias Unidas”. También es posible que el Tribunal de Texas ordene la finalización permanente del programa “Manteniendo a las Familias Unidas”. En este momento, simplemente no sabemos cuándo o si las solicitudes del programa “Manteniendo a las Familias Unidas” serán aprobadas en el futuro.
