H-1B FY2022 Updates – Registration Filing Window Opens March 9

United States Citizenship and Immigration Services (USCIS) has announced that the window for filing electronic H-1B registrations will open on Tuesday, March 9, 2021 at noon Eastern and will close at noon Eastern on Thursday, March 25, 2021.

Any employer seeking file an H-1B petition on behalf of a foreign worker must submit a registration on the worker’s behalf during this filing window.

USCIS intends to notify employers of any selected registrations by March 31, 2021.

Additionally, USCIS has confirmed that the lottery will be conducted based upon random selection.

The final rule that would have modified the H-1B selection process to favor positions that offer higher wage relevant to their occupational category has been delayed until December 31, 2021. USCIS has confirmed that all H-1B selections prior to December 31, 2021 – which will presumably be all selections for Fiscal Year 2022 – will conducted randomly.
