Consultations
A legal consultation is a confidential meeting that provides you with an opportunity to discuss your immigration situation and your goals with an experienced attorney. On the day of the consultation, you will meet with one of attorneys to review your case history and to outline a strategy.

To make the most of the consultation, it is important to upload or drop off any documents relevant to your case prior to the meeting. If a follow-up consultation is required, there may be supplemental costs in addition to the initial consultation fee.
Please note that attending the Consultation does not create an attorney-client relationship. This relationship is only established after both parties agree to work together and sign a Fee Agreement.
Regardless of whether we decide to work together on your case, you will leave the consultation with a clear and honest outline of the potential options, obstacles, and costs for your case.

Fee Agreements and Costs
After a consultation with one of our experienced attorneys, the next step is to review and sign a Fee Agreement.
At Kolko & Casey, P.C., there are two basic types of fee arrangements:
Flat Fee Agreement
Our Firm handles many cases on a flat fee basis. This means that the client pays a fixed attorney fee that covers the reasonable and customary legal services related to the case. The flat fee is determined by the attorney after an evaluation of the type of case, the specific facts, and the legal issues in the cases.
The client is also responsible for paying any applicable filing fees charged by U.S. Citizenship & Immigration Services (USCIS) and/or the U.S. Department of State (DOS). The attorney will outline these costs during the consultation.
Hourly Fee Agreement
Our Firm also handles many cases at an hourly rate. All removal defense cases are handled on an hourly basis, as well as other cases where the timeline and/or work involved are difficult to predict at the outset.
Our office charges by the hour for the professional work that the attorney and staff complete on the client’s case. The client also pays for all administrative costs and expenses, which can include filing fees, photocopies, mailing costs, medical exams, passport photographs, English translations, and record requests.
For hourly cases, our office maintains detailed time records and provides our clients with monthly invoices that detail the work performed and costs incurred from the previous month.
To sign an Hourly Fee Agreement, our clients must make an initial deposit, which is maintained in the client’s trust account. Our clients must also maintain a minimum balance in their trust account. The attorney will review these requirements during the consultation.
Our office accepts payments by cash, check, credit card, and bank or wire transfer.
Immigration Myths & FAQ
Q: Do I really need a lawyer?
Yes. Immigration law is extremely complex and the stakes are high — your immigration status affects your family, your freedom, your career, and your ability to live in the country of your choice. One small error can cause delays, denials, or worse. It only makes sense to hire the best possible attorney for you, your family, or your business.
Q: I can hire an immigration consultant or notary for a lot less money. Should I do this instead?
Immigration consultants and notaries (also called “notarios”) are not lawyers. It is against the law for them to give you legal advice, and many are not allowed to represent you before the immigration agencies and Immigration Court. Although in some countries the word “notario” is synonymous with “lawyer,” that is not true in the United States.
Although these non-lawyers will tell you that they can do everything as well as an experienced attorney, most of them simply do not have the same training and expertise as an experienced attorney. Immigration law is complex, political, and constantly changing. Each case has its own unique set of facts and circumstances. Only an experienced attorney has the knowledge to apply the law to the facts of your life.
Keep in mind that USCIS, the Colorado Supreme Court, and many other courts and government agencies recommend against hiring a consultant or notary.
Q: What will a lawyer do for me?
A good lawyer will learn the facts of your particular situation during the consultation and provide an honest assessment of your case. A good lawyer might advise you that you do not have any viable immigration options at the moment. The lawyer will give you an idea of what to expect in terms of outcomes, timelines, and attorney fees/costs. They will also help you gather the necessary information and documents, complete and file the appropriate forms on time and in the right place, and make all necessary appearances on your behalf. The lawyer will explain the choices that you must make and provide you with the pros and cons of each option. The lawyer will keep you updated on the many changes in immigration law and be familiar with the people who will be making the decisions on your case.
Q: What kind of fees will I have to pay a lawyer?
Many immigration lawyers work on a flat fee basis, which means that you will pay a fixed amount for the specific application process. In some cases, an attorney might charge you on an hourly basis. In addition to the attorney fees, you may also have to pay administrative costs and filing fees. Your lawyers should give you a clear explanation of all fees and costs.
Q: My lawyer says that a paralegal will be doing some of that work on my case. Is that okay?
Yes. Paralegals that work under the supervision of a skilled and experienced attorney do an excellent job. In turn, they bring important and valuable skills and experiences to the firm (for example, fluency in other languages). At our firm, the paralegals establish a strong relationship with our clients and bring many years of experience working in the immigration field.

Associate Attorney – June 2024

We are currently seeking an Associate Attorney focusing on family and/or employment-based immigration cases.
Candidates should have:
- Our preferred candidate will have at least 1-3 years of experience as an Immigration Attorney

- Ability to prioritize and multi-task; as well as be deadline and detail oriented.

Job Duties: Oversee and manage family and/or employment-based immigration cases under supervision of Partners, including but not limited to:
- Family-based permanent residency and naturalization applications;
- Consular Processing of immigrant visa applications;
- Removal defense and waiver cases;
- Humanitarian-based applications including asylum, VAWA, U visa, TPS and DACA applications
- Non-immigrant visa petitions (E-2, E-3, H-1B, H-2B, L-1, O-1, P-1, Q-1, R-1, TN) and port of entry packages;
- Temporary and Permanent Labor Certification applications with DOL;
- Employment based permanent residency applications;
- In addition, manage client communication; attend client meetings; conduct; consultation meetings with prospective clients under supervision of Partners.
